Creditors’ Rights and Bankruptcy

Financial institutions must often deal with a turbulent economic environment. The members of Stuart & Branigin's Creditors' Rights and Bankruptcy practice group serve financial institutions and businesses in Indiana and beyond. We know the law and have the experience needed to achieve our clients' goals.

Our clients include commercial banks, credit unions, and other lenders. We also advise our business, nonprofit agency, and institutional clients regarding creditors' rights matters, and we provide creditors' rights and bankruptcy counseling to various clients relating to consumer loans and commercial indebtedness. We routinely advise clients about:

  • Actions against borrowers and guarantors
  • Real estate foreclosures
  • Enforcement of remedies under security agreements, mortgages, assignments of rent, and personal property leases
  • Workouts and collections of problem commercial loans and trade credits
  • Prevention and defense of lender liability claims
  • Enforcement of creditors' rights in bankruptcy proceedings and defense of avoidance and preference actions

Our attorneys are experienced in both routine and complex litigation and bankruptcy matters. We understand the value of continuing education and participation in relevant associations, including the American Bankruptcy Institute, the Commercial Law League and the Bankruptcy and Creditors' Rights Section of the Indiana State Bar Association. We know that membership in such associations is important to the continued development of our knowledge in the practice area, but we also recognize that active participation adds even greater value. Our attorneys have served as chairman of the Bankruptcy and Creditors' Rights Section of the Indiana State Bar Association, the editor of its publication, and as contributors to the same publication.

Our goal is to provide excellent representation in the bankruptcy and creditors' rights area that meets or exceeds the expectations of our clients. This has been Stuart & Branigin's goal for generations and will continue to direct our efforts in the Creditors’ Rights and Bankruptcy practice area.
